The Academic Staff Union of Universities (ASUU) must start resume work immediately, according to the Abuja Division of the Court of Appeal.
The appellate court issued the ruling today while granting ASUU permission to appeal Justice Polycarp Hamman’s interlocutory injunction, which ordered union members to return to work on September 21, 2022.
ASUU was cautioned by Justice Hamma Barka’s court that if it disobeyed the order, it would immediately forfeit its right to appeal the lower court’s decision.
However, based on the move of the applicant’s attorney, Femi Falana (SAN), for the withdrawal of the application, it dismissed ASUU’s request for a stay of the Industrial Court’s ruling.
Justice Hamma Barka, the three-person panel’s chairman, gave ASUU seven days to file its notice of appeal of the lower court’s decision after reading the lead decision.
